H P High Court dismissed all the petitions related to the recruitment for the post of JBT Teachers

SHIMLA----The High Court of H.P. today dismissed all the petitions related to the recruitment for the post of JBT Teachers, wherein relaxation in qualification criteria, i.e. exemption from the Teachers Eligibility Test (TET) was sought for. The judgement has been  passed by a Division Bench comprising of Justice Dharam Chand Chaudhary and Justice Vivek Singh Thakur in an LPA filed by the State against the orders of the Single Bench passed in a bunch of petitions, wherein the petitioners were seeking  relaxation in TET qualification for recruitment to the post of JBT Teachers.The Division Bench passed these orders after setting aside the decision of Single Bench, whereby the Single Judge had directed the State Government to consider the case of the petitioners as per law.

While allowing the LPA, the Court held  that the TET qualification is compulsory for recruitment to the post of JBT under Right to Education Act and the appointment should be made strictly in accordance with these Rules. As per the candidates, who were party respondents in this matter, they had taken admission in the Rajeshwari Teachers Training Institute, Kullu in the year 2002 and 2003, for two years JBT course. Their course was complete in the year 2005, but due to different reasons, the examination could not be conducted within the stipulated time. They were allowed to take their final examination alongwith the 2008 batch and they qualified the examination after September, 2011. On 23rd August, 2012, the State Government made TET qualification mandatory for recruitment to  the post of JBT Teachers. Thereafter, on 12.09.2012, the Govt. decided to fill up 1300 posts of JBT Teachers. The applicants had pleaded that they were enrolled to the Course of JBT in the year 2002 and 2003 and it was only their final examination which took place in the year 2010 and 2011, therefore, they had requested that they must be treated against the batch of 2002 and 2003. They had further requested for exemption from TET qualification for the post of JBT. But the Court held that the qualification of TET is compulsory for the post of JBT.

It is in the aforesaid backdrop that the qualification of TET has been held to be a mandatory for recruitment to the post of JBT Teachers by Division Bench in the aforesaid Letters Patent Appeal.
