The High Court of H.P. while hearing the writ petition regarding appointment of Anganwari Workers observed that in the guidelines issued in this behalf, some mechanism needs to be indicated with all certainty so that the person aggrieved should know that the limitation for filing the appeal against selection/appointment of anganwari worker/helper will start running from the appointed day.

A Division Bench comprising the Justice Dharam Chand Chaudhary and Justice Vivek Singh Thakur made the aforesaid observations, on a writ petition filed by Ms. Praveen Devi of District Kullu. It was alleged in the petition that interview for the post of Anganwari worker was conducted and one Smt.Ruveena Kumar was selected and appointed. Ms.Praveen filed the appeal against the selection on the ground that the appointee had concealed the actual income of her family. The petitioner has alleged that the appeal was dismissed by the ADM, Kullu on the ground of delay without touching the merits of the case, though she was more qualified than the appointee.

During the course of hearing, the Court observed that at different times, different guidelines came to be framed and sometime in complete departure to the guidelines in vogue at the time of re-framing or modifying the same. The Court also observed that there should have been uniformity in the guidelines, particularly concerning with prescribing the limitation for filing an appeal by the aggrieved person against the appointment of candidate as Anganwari worker/helper.

The Court posted the matter for further hearing on 26.09.2018.
