Encroachment on Govt. land by weaker sections to be viewed sympathetically


Shimla--Encroachments on Government land by the poorest of the poor, whose annual income does not exceed Rs 45,000 would be considered sympathetically for regularization provided encroachments in urban areas was upto 25 square metres and that in rural areas does not exceed five bighas. This was proposed in the meeting of the Cabinet Sub Committee on Himachal Pradesh Regularization of Encroachments (in certain cases) on Government Land Rules, 2002, held here today under the Chairmanship of Thakur Gulab Singh, Revenue Minister.

Thakur Gulab Singh said that Cabinet Sub Committee proposed that while regularizing encroachments in rural areas, it would be ensured that own land of the encroacher and the land regularized does not exceed five bighas, provided that the remaining encroached land was vacated. He said that similarly in the urban areas only 25 square metres land would be considered for regularization provided that the encroachment in excess of 25 square metres was vacated. He said that for this the encroachers would have to make payment of half the latest one year average value of the land encroached upon.

Revenue Minister said that the land being used for common village purposes such as roads, Mela Grounds, cattle shelter grounds, grounds where religious and other ceremonies are held, village ponds etc. would not be regularized in any case. He said that in case where the encroachment has been made by more than one co-sharers, the Committee proposed that the encroachments would be regularized in favour of all such co-sharers proportionately.

Thakur Gulab Singh said that encroachment would be regularized only in the cases in which the encroachment was found to have been made on or before 31st December, 2000. He said that any subsequent encroachment would be not be regularized and the encroacher would be ejected in accordance with law. He said that where the encroachers have been evicted, would not be considered for regularization.

He said that the proposals of the Cabinet Sub Committee would be placed before the Cabinet in its next meeting for its approval.

Dr Rajeev Bindal, Health Minister and Shri Jai Ram Thakur, Rural Development and Panchayati Raj Minister, Members of the Cabinet Sub-Committee gave their valuable suggestions during the meeting.

Shri P. Mitra, Principal Secretary, Revenue, conducted the proceedings of the meeting.

Shri Sudipto Roy, Principal Secretary Forests, Shri K.K. Pant, Secretary Finance and other senior officers attended the meeting among others.
