SHIMLA------------- The High Court of H.P. today appointed Mr.Deven Khanna, Advocate as Amicus Curiae and requested him to file the report regarding illegal felling of hundreds of trees and construction of roads in the Nachan Forest Division on 10.04.2018, after visiting the spot and getting the entire area videographed. The Court also directed the Conservator of Forests, Mandi to file short affidavit before the next date of hearing.
A Division Bench comprising Hon'ble the Acting Chief Justice Sanjay Karol and Justice Ajay Mohan Goel passed these orders on a petition taken up suo moto on an application moved by one Shri Mohan Singh of Jiuni Block, Tehsil Chachiot, District Mandi. The petitioner has alleged in the petition that illegal felling of hundreds of trees of various species is being carried out in the Nachan Forest Division and roads are being constructed through the forests, but the Forest Department is not taking any action against the defaulters. He has further alleged that due to large number of felling of trees in the area, it has become difficult to feed the cattle and there is danger to the environment also. The petitioner has also alleged that such illegal action could not have taken place without the knowledge, consent or collusion of the forest officials, District administration and the elected public representatives of the area. The petitioner has requested that the national forest wealth may be saved.
During the hearing, the Court directed the Chairman, District Legal Services Authority, Mandi, Sub Divisional Magistrate, Gohar and Dy.Superintendent of Police, Gohar, to accompany the Amicus Curiae and render all assistance to him. The Court also directed the Deputy Commissioner, Mandi to provide professional person to videograph and photograph the entire stretch of road and forest where the trees stand felled and the road has been constructed.
