SHIMLA-----High Court of H.P. today directed the Chief Secretary to the Himachal Pradesh to ensure that all those officers, who have been arrayed as party respondents in the contempt petitions or who have to remain present before the court in the cases on the date fixed, have to seek exemption/permission from the court before leaving for Delhi or outside the state. Court also made it clear that any deviation in this regard shall be viewed seriously. On previous date of hearing the court had directed DGP, Himachal Pradesh to remain present before the court. But today instead of remaining present in person before the court, the DGP had sent Additional Director General of Police who brought it to the notice of the court that DGP has gone to the Delhi in connection with some personal work. The same directions were also passed by the court in COPC No. 188 of 2016 on 4th of October, 2016. The Court also directed the Additional Advocate General, to convey order to the Chief Secretary for strict compliance of the order. Court also made it clear that in case of noncompliance of the orders the court would be constrained to initiate contempt proceedings against the entire erring officers/officials. Now the court has again directed the DGP, Himachal Pradesh to remain present in person before the court on 22nd December, 2016

Division Bench comprising the Chief Justice Mansoor Ahmad Mir and Justice Sandeep Sharma passed these orders on a petition taken up suo moto by the Court as Public Interest Litigation on the news paper reports which appeared in different news papers regarding the illicit drug trade in the State of Himachal Pradesh in the month of July 2015. It was reported in the news items that drug trafficking is on rise day by day in the state.
