SHIMLA---The High Court of H.P. has directed the Commissioner MC, D.C. Shimla and Tehsildar (Recovery) Shimla to initiate proceedings immediately against the defaulters in the matter of House Tax Recovery in Shimla Town.
A Division Bench comprising Chief Justice Mansoor Ahmad Mir and Justice D.C. Chaudhary passed these orders on a petition taken up suo moto by the Court on a news item regarding non-realization of house tax by the Municipal Corporation, Shimla.
In an affidavit dated 4th September, 2015, filed before the Court, the Commissioner, Municipal Corporation, Shimla informed the Court that after the High Court took cognizance of the matter, the Corporation was able to recover an amount of Rs. 10,71,80,839/- for the assessment year of 2014-15 & 2015-2016 as per new system of tax recovery till date. Commissioner, MC has further informed the Court that an amount of Rs. 86,91,715/- is yet to be recovered from remaining 415. It was further informed that MC, Shimla has finalized 30 cases for initiating action under section 124 of MC Act Shimla.
The Court today directed Commissioner, MC, Shimla, Deputy Commissioner, Shimla & Tehsildar Recovery, Shimla to file fresh status report regarding the recovery of House Tax & action taken against the defaulters on or before 5thNovember, 2015 on which date the matter will be listed before the court for further herring.
