SHIMLA------The High Court of H.P. today issued notices to the State on a petition seeking permission to ply the Golf Cart in Shimla City. The Court further directed the State to file reply in this matter. Now the matter will be listed before the Court on 30th September for further hearing.
A Division Bench comprising the Chief Justice Mansoor Ahmad Mir and Justice Tarlok Singh Chauhan passed these orders on a petition filed by Sanjay Chauhan, (Mayor MC Shimla) and Tikinder Panwar (Deputy Mayor MC Shimla) alleging that the state has denied the plying of Golf Carts in Shimla city which was proposed by municipal corporation Shimla On sealed and restricted roads in larger public interest. The same was rejected by the Director, Transport ground that the Golf Carts were not approved by Automotive Research Association of India under Rule-126 of Central motor vehicles Rules, 1889. Secondly on the ground that these vehicles can only be plied with in the enclosed premises and public roads could not be considered as enclosed premises.
The petitioners stated in the petitioner that operation of battery operated vehicle is more environment friendly because there is burning of fuel and eco friendly.
The petitioner has prayed in the interim directions that the Director Transport may be directed to issue No Objection certificate in favour of the M.C Shimla but the Court has rejected the same plea at this stage.
Now the matter will be listed on 30-09-15.
