Shimla---- The High Court of H.P. directed the Secretary (Transport), Govt. of H.P., General Manager, H.P. Bus stand Management and Development Authority and Chief Executive Officer, HRTC, Shimla to appear before the Court in person on 12.10.2015 on the issue of converting the waiting Room into of Shopping Complex at the Old Bus Stand Shimla. The Secretary (Transport) had already filled reply in this matter but on the perusal of same the Court expressed its dissatisfaction over the same.
A Division Bench comprising the Chief Justice Mansoor Ahmad Mir and Justice Tarlok Singh Chauhan passed these orders on petition filed by Asha Chauhan alleging that the respondents are planning to construct a shopping complex at old bus stand Shimla. During the hearing it was observed by the court that public interest is involved in this matter and treated it as Public interest Litigation and the notices were issued to the respondents.
The petitioner has challenged the Tender Notice issued in the month of January, 2015 wherein, tenders were invited by the H.P. Bus Stand Management and Development Authority, Shimla for the repairing work of the Old Bus Stand, Shimla. It was further alleged that under the garb of repairing work, the Authority is converting Waiting Room into Shopping Complex at same place.
The petitioner further alleged in her petition that there are many instances where lady passengers are being harassed by the persons who are in the habit of eve teasing & harassing the ladies and these lady passengers used to feel secured in such waiting rooms. But the Management is more concerned with there profit rather then such social issues.
