CRIMINAL CASE AGAINST DALAI LAMA IN INDIAN COURT OF LAW

DHARMSHALA----Dorje Shugden, a rival sect, has filed a petition in the Delhi high court against the Dalai Lama and Samdhong Rinpoche Kalon Tripa (Tibetan Prime Minister in exile), who is heading Central Tibetan Administration (CTA). Dorje Shugden has alleged that Dalai Lama and the CTA were violating their human rights and religious freedom. The central and state governments are other respondents in the writ petition. The CTA has appealed to Tibetans to maintain peace and not to react violently to the writ petition.

The petition filed by Dorje Shugden assumes significance in view of the fact that the Tibetan authorities are apprehending that followers of the sect are being used by the Chinese government against the Dalai Lama. The Dalai Lama’s security was also strengthened recently amidst reports that some Shugden followers had infiltrated into India.

Dorje Shugden is believed to be a wrathful spirit of murdered Gelukpa Lama, who had opposed the 5th Dalai Lama both in debate and politics. He was found dead under mysterious circumstances.

Jampel Yeshe, President, Dorje Shugden Devotees Charitable and Religious Society These human rights violations are being carried by Tibetan government-in-exile, headed by the Dalai Lama, against tens of thousands of Tibetans who are living in India and who worship one particular Buddhist Deity known as Dorje Shugden. This Deity has been worshipped for many generations by millions of people throughout the Mahayana Buddhist world.

The Tibetan government-in-exile has carried out a forced signature campaign within all the Tibetan communities in India. People are being forced to sign a declaration stating that they will stop worshipping the Buddhist Deity.

The Tibetan government-in-exile has threatened to withhold financial support provided by Western aid agencies from Tibetan refugees who refuse to sign the above mentioned declaration.

Groups from the Tibetan Women's Association and the Tibetan Youth Congress have made house-to-house searches in the homes of Tibetan refugees to see who is worshipping the Deity Dorje Shugden. Religious images have been removed and destroyed. The houses of many religious teachers and monks who rely on this Deity have been smashed. People have been physically attacked and intimidated, and at least one monk has been hospitalized.

Children whose parents engage in the practice of this Deity have been thrown out of Tibetan schools, and a number of Tibetan government employees have lost their jobs for refusing to give up the practice of this Deity.

As per information received from the High Court of India,New Delhi,I am told,that there was a recent hearing on the Dorje Shugden case on the 14th of september.This was the 3rd hearing in response to a riposte,that had earlier been provided by the Advocate of the Dalai Lama-that too,after a lapse of 9 and a half months-precisely speaking!The 3rd Judge in question,was unlike the 2nd,who had expressed reservations and unwillingness to dictate a ruling-as a decision-but,on the contrary was also open to the re-addressal of the affair.
This Judge,as pointed,dismissed the Dalai Lama's arguments as inconvincing,further asserting,that,'there was sufficient documentation of evidence available to prove that the Dalai Lama was in fact and indeed,persecuting followers of the deity Dorje Shugden and,that this would have to cease henceforth.A notice in this regards would be sent to the DL as a warning to desist.Notwithstanding which,the Judge declared,that punitive measures would be initiated,would the DL not restrain from his persecutive acts.
