High Court of H.P. today directed the Municipal Council, Nahan

SHIMLA----    The High Court of H.P. today directed the Municipal Council, Nahan, to show cause as to why it should not be dissolved in accordance with the H.P. Municipal Act, 1994, for having failed to carry out its functions and duties as provided under the Act and Rules and Bylaws. The Court observed that from the records , it appears that the Municipal Council, Nahan, is not at all interested in having the illegal encroachment/ unauthorized construction removed and proceeding against such persons in accordance with law. Besides, the Court directed the Executive Officer, Municipal Council, Nahan, to appear before it on the next date of hearing.

The Court also directed the Principal Secretary( Urban Development) to the Govt. of H.P. to personally look into the affairs of the Municipal Council, Nahan, especially, with regard to encroachment/ unauthorized constructions that have come up in the municipal area within last decade and  further asked  to file affidavit of compliance on the next date of hearing.

            A Single Bench comprising Hon'ble Mr. Justice  Tarlok Singh Chauhan passed these orders on a petition filed by one Anil Aggarwal, resident of Nahan, involving an alleged encroachment.

            The matter is next listed for 05/04/2019.
