SHIMLA------The High Court of Himachal Pradesh appointed Mr.Deven Khanna, Advocate as a Local Commissioner to visit the spot and get the videography done of the entire area, falling within the territorial limits of Municipal Corporation, Dharamshala and also Bhagsunag, Naddi, Mcleodganj and Dharamkot and ascertain the factual position with regard to the illicit felling of trees and violation of environmental law of the land. The Court also requested the Amicus Curiae to visit the area for such purpose.
A Division Bench comprising the Acting Chief Justice Sanjay Karol and Justice Ajay Mohan Goel passed these orders on a petition taken up suo moto by the Court as Public Interest Litigation on a letter written to the Chief Justice by Ghazala Abdullah. The petitioner had alleged that a large number of Deodar trees were being felled in Mcleodganj at Dharamshala for the purpose of commercial activities and when she approached the A.S.P., D.C., Municipal Corporation, Forest Department, Panchayat Pradhan, & CID department regarding the matter, no action was taken by the authorities. In this case the court had also appointed Amicus Curiae to make verifications and to visit the spot regarding the illegal felling of trees.
During the hearing, the Court observed that despite pendency of the present petition, at least 10-12 trees stand felled in Bhagsunag area, but none bothered to examine the matter. Even the Officers of the Municipal Corporation, Dharamshala as well as the Municipal Commissioner, Dharamshala were telephonically informed about the incident.
The Court posted the matter for 24.04.2018.
