HP High Court issued notice to the state over the issue of misuse of official power

SHIMLA---The High Court of Himachal Pradesh today issued notice to the state over the issue of misuse of official power by the Block Officer,  Pargana Forest Block in Karsog Forest Division the court further issued direction to file reply in this matte.

A Division Bench comprising the Chief Justice Mansoor Ahmad Mir and Justice Sandeep Sharma passed these orders on a writ petition filed by one Kushal Chand. The petitioner has alleged in the petition that Block Officer, Pargana Forest Block in Karsog Forest Division has allocated trees in excess of his sanctioning power and unauthorized   road has been made over the area where trees have been illegally felled.  The petitioner further alleged that the forest land is being dug out for construction of this unauthorized road in violation of Forest Conservation Act. The petitioner has also pointed out in his petition that he made a complaint against this to the Divisional Forest Officer and a committee was constituted to inquire this matter. The petitioner along with the said committee members visited the spot. The petitioner further alleged in that before investigation could be started the petitioner was brutally attacked and thrashed by 60-65 people & Gram Panchayat members.

The petitioner has prayed in the petition that respondent may be directed to carry out proper detail inquiry into the illicit timber distribution/marketing which is being carried out in the area. The inquiry may be directed to be conducted under the police protection. Directions may be issued to conduct the inquiry in time bound manner.

The matter will be now listed before the Court on 31stAugust, 2016 for further hearing.
