SHIMLA----The High Court of H.P. today directed the National Highway Authority of India to pay some of Rs. 500000/- (rupees five lacs) to the applicant immediately as interim measure. Court further issued direction to provide suitable alternative accommodation to the applicant after assessing the damage caused to his house while undertaking the construction of tunnel work at Sunder Nagar in Mandi district.
A Division Bench comprising the Justice Rajiv Sharma and Justice Dharam Chand Chaudhary passed these orders on a petition filed by one Krishan residents of village Gamohu, Sunder Nagar, Mandi. The petitioner has alleged in his petition that his property has been damaged by the IL&FS Engineering and Construction Company by doing illegal and unscientific blasting in the construction work of medium tunnel T-5 on NH-21 which is passing under the his property. The petitioner has further alleged in the petitioner that he had already made representations to the National Highway Authority of India and other concerned authorities in this regard. And when no action was taken on their representations he approached the Court by way of writ petition.
The petitioner has prayed to direct the respondents to stop the construction work of the tunnel immediately or at least stop the blasting work in construction of the tunnel
