High Court of H.P. today granted two months’ time to the Municipal Corpration, Shimla

SHIMLA-------The High Court of H.P. today granted two months' time to the Municipal Corpration, Shimla to complete the process of finalizing bye-laws and make the same operational by the next date of hearing.

            A Division Bench comprising Chief Justice Mansoor Ahmad Mir and Justice D.C. Chaudhary passed these orders on a petition taken up suo moto by the Court on a news item regarding non-realization of house tax by the Municipal Corporation, Shimla.

            In its status report filed in the Court, the Municipal Corporation said that it has made recoveries more than half of the due amount from the defaulters. The Municipal Commisisoner submitted that Rs. 5.50 crore was due from 2205 defaulters till March 31, 2012. Now a balance amount of Rs. 2.44 Crore is due from the remaining 730 defaulters, which include the amount of Rs. 53 lacs due from the Government departments. Of the remaining 730 cases, 87 have been transferred to the Tehsildar (Recovery).

            The Corporation also told the Court that General House of the Corporation after detailed deliberation on the issue has finalized the draft bye-laws and these bye-laws need no approval of the Govt. as per amendment carried out in Section 397 of HPMC Act, 1994. It also told that the Corporation has invited objections in terms of Section 397 of the H.P. Municipal Corporation Act, 1994 in order to complete the process of framing bye-laws.

            The Court also directed the Tehsildar (Recovery) to effect recovery as early as possible and the Corporation and Tehsildar (Recovery) to file status report before next date of hearing. The Court posted the matter for October 16, 2014.
